Welcome to MusiVo AI ("Platform", "we", "us", or "our"), an advanced Neural AI Music & Audio Synthesis Workstation developed and operated by the Mikyhost Team. By registering an account, accessing our web studio, purchasing credits, generating audio, or downloading music tracks, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms").
1. Eligibility & Creator Accounts
- Age Requirement: You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use MusiVo AI.
- Account Integrity: You agree to provide accurate and complete registration details during sign-up and email OTP verification.
- Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.
- Anti-Abuse: Creating automated duplicate accounts to farm free credits is strictly prohibited and subject to immediate termination.
2. Neural AI Studio & Nature of Generated Audio
MusiVo AI provides access to cloud-managed generative neural audio models capable of synthesizing music tracks, vocal layers, lyrics, stem separations, and album artwork based on text prompts and parameters:
- Probabilistic Technology: AI synthesis is inherently non-deterministic. We do not warrant that generated tracks will meet specific artistic expectations, match existing songs, or produce identical results across multiple attempts.
- Neutral Tool Provider: MusiVo AI operates strictly as an automated technological audio creation tool. We do not act as a music publisher, record label, distributor, or legal guarantor of novelty.
3. Sole Creator Responsibility & Intellectual Property Warranty
User Ownership of Inputs: You retain ownership of all original lyrics, melodies, prompts, and audio samples that you provide to the Platform.
Sole Legal Liability for Outputs: You expressly acknowledge and agree that YOU ARE SOLELY AND EXCLUSIVELY LEGALLY RESPONSIBLE for all audio tracks, lyrics, songs, stems, videos, artwork, and metadata generated, downloaded, published, streamed, distributed, or monetized by you through or from MusiVo AI.
User Warranty & Representation: You represent and warrant that your inputs, custom lyrics, and resulting creations do not and will not: (a) infringe upon, misappropriate, or violate any third party’s copyright, trademark, patent, trade secret, moral rights, voice likeness, or publicity rights; (b) contain defamatory, unlawful, hateful, or harmful material; or (c) violate any applicable national, international, or local intellectual property laws.
Commercial Licensing (Paid Plans): Active subscribers on paid plans (Pro / Studio / Enterprise) and purchasers of credit packs receive a 100% Royalty-Free Commercial License to distribute and monetize their synthesized tracks on platforms such as Spotify, Apple Music, YouTube Content ID, TikTok, video games, film/TV soundtracks, podcasts, and commercial advertisements without recurring royalties owed to MusiVo.
Public Showcase License: If you explicitly mark a track as Public or publish it to your Creator Channel, you grant MusiVo AI a non-exclusive, worldwide, royalty-free license to stream and showcase the track within our Explore feeds.
4. Complete Indemnification & Hold Harmless Release
UNCONDITIONAL LEGAL INDEMNIFICATION: To the maximum extent permitted by law, you agree to unconditionally defend, indemnify, and hold harmless MusiVo AI, Mikyhost Team, and its affiliates from and against ANY and ALL claims, demands, liabilities, lawsuits, damages, royalties, fines, and legal expenses arising out of: (a) Any song, audio stem, vocal rendition, lyrical text, video, or artwork generated, uploaded, downloaded, distributed, or monetized by you; (b) Any third-party claim alleging copyright, trademark, publicity right, voice likeness infringement, or defamation; (c) Your distribution or monetization of tracks on external streaming platforms (Spotify, Apple Music, YouTube Content ID, TikTok, etc.); (d) Any breach of these Terms.
5. DMCA & Copyright Infringement Takedown Policy
MusiVo AI adheres to standard notice-and-takedown procedures under the DMCA. If a copyright holder believes content infringes their work, they may submit a takedown notice to [email protected]. We reserve the right to disable or remove the disputed file without liability to the user and terminate repeat infringers.
6. Credit Tokenomics, Subscriptions & Payments
- Credit Usage: AI actions consume credits as indicated in the studio.
- Payment Gateways: Securely processed via Stripe, Plisio Crypto, and Midtrans.
- No Refunds on Consumed Credits: Because GPU/neural computing resources are permanently allocated at generation, consumed credits are strictly non-refundable.
- Subscriptions: Plans renew automatically unless canceled prior to renewal.
7. Acceptable Use & Prohibited Conduct
You agree not to generate or upload hate speech, defamatory or unlawful material; impersonate living artists without authorization; scrape or overwhelm our AI infrastructure; or circumvent credit deduction counters.
8. Disclaimer of Warranties & Limitation of Liability
"AS-IS" Basis: MusiVo AI is provided without warranties of any kind. Mikyhost Team does not warrant that outputs are unique or free from acoustic similarities to existing musical works.
Liability Limitation: In no event shall MusiVo AI or Mikyhost Team be liable for indirect, incidental, or consequential damages, lost royalties, or distribution rejections. Our total liability shall not exceed the amount paid by you in the preceding three (3) months.
9. Account Termination & Governing Law
We reserve the right to suspend or terminate accounts violating these Terms. Governed by applicable international laws.
